Terms of Booking

TERMS OF BOOKING:

  1. The keys for the house shall not be handed over to the Tenant until such time as full and final payment of all rentals has been received.

  2. After payment of the balance the Tenant will be advised about collection of the keys from the Managing Agent. Normal business hours are Monday to Friday 8:00 – 16:30, but special arrangements can be made for collection and returning keys after hours, weekends and special holidays. Lost keys and replacement locks will be charged to Tenant.

  3. If a reservation needs to be cancelled, it will only be done if cancellation notice is received in writing and not less than 30 days prior to arrival. A handling fee of 20% of the total rental will be charged on the cancelled booking. Should the booking be cancelled within 30 days of date of arrival and we are unable to re-let the property, the Tenant shall be responsible for the full amount of the rental, irrespective of whether the house is occupied for the full rental period of the lease or not.

    • We will attempt to secure a replacement booking, however no guarantees can be given that a replacement booking will be found.

    • If a complete replacement booking of the same value is secured, then the booking deposit will be refunded less 10% of total booking value.

    • If a replacement booking of a lower value is secured, the Tenant will be liable for the balance, unless consent from the property owner to accept the lower value is obtained.

    • The Tenant may not sublet the premises.

  4. Exclusion from rental: When the accommodation is taken up, the retention (breakage deposit) will be used for the replacement of damaged or missing items on the inventory, repair, cleaning or replacement of damage to furniture or fittings, special hire charges, unpaid rental and an exit clean and laundry charge (unless specified on the rental invoice). The retention (breakage deposit) will be refunded within 30 days after departure. Please take note that, as breakages are replaced with matching items, no replacements bought by tenants will be accepted in lieu of the deposit.

  5. The property is accepted as including all furniture, fittings and accessories “voetstoots” and in the condition in which they are found, and shall be left in the same order in which they are found, and shall be left in the same order and good condition, fair wear and tear excepted. The Landlord takes no responsibility for the breakdown or malfunction of appliances during the tenancy, however, we will make every effort to repair any faulty appliances which are reported to us. The Tenant shall be responsible for any shortages or breakages during his/her occupancy. A shortened version of the inventory of the contents of the house will be found in the envelope provided by Bay Holiday Homes and should be checked on arrival as well as at departure. An inventory is taken by Bay Holiday Homes before and after your visit. Any shortfall must be reported to the Managing Agent within 24 hours of arrival, otherwise it will be assumed that the inventories are correct. The Tenant is expected to leave the premises in the condition he found it in on arrival.

  6. Tenants renting more than one cottage should refrain from moving bedlinen, utensils, crockery, cutlery or any other items on the inventories from one cottage to another. When inventories are checked after departure, any items found missing from a specific cottage will deemed to be lost and charged for.

  7. The alarm system must be armed whenever possible. All household items and furniture should should be stored in the house overnight and whilst the property is unoccupied. The Tenant will be held responsible for all/any losses and damages should the above not be adhered to. A call-out fee of R200 + VAT will be charged if the Tenant fails to store items and arm the alarm at departure.

  8. The number of people that is permitted to occupy the house is 6 (SIX) except Seagull B is only 4 (FOUR). No extra persons may occupy without the Landlord's written consent. The introduction of extra persons without permission shall be ground for immediate cancellation of this lease and eviction of the tenant/s with no refund of deposit and/or rental. Only the tenant according to our records may occupy the property.

  9. Pets are NOT allowed. This is the rule of the Home Owners Assosiation and we have no say in the matter.

  10. In the event of any dispute arising out of this tenancy the Tenant hereby consents (in terms of Section 45 read with Section 28 of Act 32 of 1944 as amended) to the jurisdiction of the Knysna Magistrate Court for the determination of such issue.

  11. EFT payments are accepted. Please email proof of payment. Online Credit Card and Paypal will be available soon. However, you may request a Paypal payment.

  12. The Tenant agrees to occupy the property at his or her own risk. In the event of an accident or injury, the owner and letting agent accept no responsibility for any loss of of whatsoever nature that may arise during the Tenant's occupation of the property. The Tenant further exempts the Landlord from any such claims that may arise against him resulting from the lease.

  13. Should complaints be received from neighbours or other occupants in the complex with regards to the conduct of the Tenant, the rental agreement will be cancelled and the Tenant evicted with no refund of deposit and/or rental.
